Momoiro Clover Z Fan Club Rules

These Rules (including associated rules and regulations) set forth terms and conditions of use of services of an official Momoiro Clover Z fan club, Angel Eyes (hereinafter, the “Services”), operated and provided by STARDUST PROMOTION Inc. (hereinafter, “Stardust Promotion”). These Rules apply to all users of the Services (hereinafter, “Member(s)”) and all Members are deemed to have agreed to the terms of these Rules. (As of August, 2023).
Article 1 (Registration and Change of Membership)
1. “Member” refers to a person who applied for member registration by following the prescribed procedure after agreeing to these Rules, and has been approved by Stardust Promotion. To register for membership, the applicant must register his/her name and other information as certified by an official identification document, and the address outside Japan stated in an official identification document where he/she can receive mail.2. Stardust Promotion will not accept any application for member registration, if:
(1)the applicant provides information that is not stated in an official identification document as specified in the preceding paragraph, or provides a false name, stage name or any false information at the time of member registration;
(2)a person already registered tries to register again;
(3)the applicant has violated these Rules in the past;
(4)the Services for the applicant have been suspended or member registration has been cancelled by Stardust Promotion in the past;
(5)the applicant does not have legal capacity to act alone and has not obtained consent of his/her guardian, including a person with parental authority; or
(6)other than the above, Stardust Promotion considers that it is inappropriate for Stardust Promotion to provide the Services to the applicant.
3.To receive the Services, each Member must pay a 1,100 yen admission fee and a 4,400 yen annual membership fee to Stardust Promotion. Payment must be made by credit card. Various fees for the payment (handling charge, service fee for sending money, etc.) must be paid by the Member.
4. Members shall process any changes in their registration information in accordance with the prescribed procedure.
Article 2 (Services)
Contents of the Services are as described below. Please note that the Services provided to members living outside Japan may be totally or partially different from the services provided in Japan.1. Announcement of most recent information (distribution of mail magazines and viewing on the Fan Club’s website)
2. Provision of members’ only contents and viewing on the Fan Club’s website
3. Shipping of member benefits and membership card (shipping cost is paid by Stardust Promotion). However, Stardust Promotion assumes no responsibility if a package or mail does not reach a Member due to postal or any other conditions.
Contents provided by Stardust Promotion may be added or reduced in the future.
Article 3 (Method for Using the Services and Renewal of Membership Period, etc.)
1. A Member may use the Services by using the member number issued by Stardust Promotion and password selected by the Member.2. Each Member is responsible for the cost, preparation and installation of communication devices, software, communication lines and all other devices, facilities and telecommunication services that are necessary to use the Services.
3. The Services are provided in Japanese. Some contents are available in English. If there is any conflict in the interpretation of contents between of the Japanese version and the English version, interpretation of contents of the Japanese version shall prevail.
4. A Member may use the Services for a period of 1 year after member registration (from the day of member registration to the last day of the month to which the first anniversary of the member registration day belongs).
5. A Member may extend the service period for another year (as calculated by the method described in Paragraph 4. above) by paying a 4,400 yen continuous annual membership fee to Stardust Promotion by following the specified procedure prior to the expiry of the 1-year service period.
6. Time noted in the Services is Japan Standard Time (JST).
Article 4 (Management of Member Number and Password)
1. Each Member is fully responsible for managing the member number issued by Stardust Promotion and password he/she selected.2. The member number issued by Stardust Promotion and password each Member selected can be used only by the Member. No Member shall allow any third party to use, or assign to any third party, or dispose of in any way, his/her member number and password.
3. Stardust Promotion assumes no responsibility for any damages suffered by a Member due to forgetting his/her password, misuse, inappropriate management, or illegal use by a third party of his/her member number and password.
Article 5 (Prohibition)
1. In using the Services, Members are prohibited from:(1)using the contents obtained through the Services for illegal or commercial purposes;
(2)allowing any third party to use or disclose contents obtained through the Services;
(3)infringing or engaging in any act that is likely to infringe copyright, trademark rights or any other intellectual property rights of Stardust Promotion, Stardust Promotion’s licensors or any other third parties;
(4)selling tickets purchased as a Member in a manner that would make Stardust Promotion objectively believe that the purpose was to obtain profits by reselling the tickets, regardless of the method (such as via Internet and face-to-face sales), and regardless of whether or not the Member actually gained profits by the resale;
(5)harming or infringing or engaging in any act that is likely to harm or infringe property, privacy or any other rights of Stardust Promotion or third parties;
(6)engaging in any acts of discrimination, indecency or any other acts that are against public order or morals, or any acts that are likely to be such acts;
(7)using or aiding to use a member number or password without due authorization by spoofing or any other means;
(8)committing fraud or any criminal offence, or an act that is likely to be a criminal offence;
(9)sending a computer virus or junk mail, hacking into computers or engaging in any acts which interfere or are likely to interfere with the operation of the Services;
(10)harming or engaging in any act that is likely to harm the reputation or trust of, or defaming, or engaging in any act that is likely to defame, Stardust Promotion or any third party;
(11)engaging in election campaigns, commercial activities or any acts for commercial purposes; or
(12)other than the above, engaging in any act which Stardust Promotion considers is inappropriate.
2. Members are fully responsible for all consequences of the actions described in the preceding paragraph.
3. If a Member violates the prohibition in this article or breaches any of the provisions of these Rules, the Member's registration may be cancelled under Article 6, or the Member will not be able to exercise all or some of the privileges granted to the Member, in accordance with the decision made by Stardust Promotion.
Article 6 (Cancellation of Member Registration)
1.If any of the following items becomes applicable to a Member, Stardust Promotion may cancel the registration of the Member without prior notice or demand. If:(1)the Member requests to cancel his/her membership;
(2)it was found that the member provided a false name, stage name or other false information at the time of member registration;
(3)it was found that the Member who had already been registered registered again;
(4)the Member’s Services have been suspended or the member registration has been cancelled by Stardust Promotion in the past;
(5)the Member does not have legal capacity to act independently and has not obtained consent of his/her guardian including a person with parental authority;
(6)the Member is engaged in any prohibited act under the preceding article, or breaches these Rules;or
(7)other than the above, Stardust Promotion considers that it is inappropriate for Stardust Promotion to provide the Services to the Member.
2. If a Member wishes to cancel his/her member registration, the Member must notify Stardust Promotion to that effect. Stardust Promotion assumes no responsibility for any damages suffered by the Member due to his/her failure to notify Stardust Promotion of cancellation of his/her member registration.
Article 7 (Non-Guarantee for the Services, etc.)
1. Stardust Promotion shall not guarantee, among other things, the completeness, correctness, applicability or usefulness, etc. of any data, etc. provided by Stardust Promotion or registered by others.2. Stardust Promotion assumes no responsibility for the data provided by the Services not being displayed correctly due to display devices, communication devices, software, communication lines or any other devices or facilities.
3. Stardust Promotion assumes no responsibility for not being able to use the Services due to the communication situation of the country or connection environment.
Article 8 (Change, Suspension and Termination of Services)
1. Stardust Promotion may change the Services by adding, changing, or cancelling the contents without prior notice to Members.2. Stardust Promotion may temporarily suspend the Services without prior notice to Members for maintenance or inspection of the system, unexpected event, or for any other reasons.
3. Stardust Promotion may terminate the entire or any part of the Services upon prior notice to Members on the Services’ website.
4. Following the procedure under the preceding paragraph when terminating the Services shall release Stardust Promotion from liability for any claim for damages by any Member or third party.
5. Stardust Promotion assumes no responsibility for damages sustained by Members due to changes to or suspension or termination of the Services.
Article 9 (Personal Information)
1. Personal information registered by a Member will be used by Stardust Promotion in accordance with the “Privacy Policy” posted on Stardust Promotion’s web page (http://www.stardust.co.jp/sd/privacy/).2. A Member may request Stardust Promotion to stop sending e-mail or any other communication by submitting a request in accordance with the Privacy Policy.
Article 10 (Revision to these Member Rules)
1. Stardust Promotion may revise these Rules and the fee separately specified (550 yen system fee) by making public to Members in advance of the revision in these Rules, the content of the revised Rules, the effective date of the revision, and other necessary matters.2. Unless otherwise specified by Stardust Promotion, the method of making public prescribed in the preceding paragraph shall be by posting on the website of the Services (http://fc.momoclo.net/pc/admission/).
3. A Member is deemed to have accepted revised Member Rules when the Member uses the Services after the date the revision of these Rules takes effect.
Article 11 (Miscellaneous)
1. All copyright and other intellectual property rights to the Services and contents provided through the Services are the property of Stardust Promotion or Stardust Promotion’s licensors.2. Members are not permitted to assign any rights and obligations under these Rules or contractual status to any third party without Stardust Promotion's prior written approval.
3. Notwithstanding any other provision of these Rules, Stardust Promotion shall compensate for damages incurred by a Member due to default or tort for reasons attributable to Stardust Promotion in providing the Services, up to the amount of the annual membership fee of 4,400 yen. However, this limit shall not apply to damages caused by Stardust Promotion's willful misconduct or gross negligence.
4. Notices from Stardust Promotion to Members will be sent via e-mail to their registered e-mail addresses. All notices are deemed to have arrived at each Member when sent, even if they do not arrive due to Member's failure to change registered information or any other reason not attributable to Stardust Promotion.
5. The formation, effect and interpretation of these Rules shall be governed by the laws of Japan.
6. Any dispute related to these Rules shall be submitted to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court, as the court of the first instance.
